- EQUIPMENT
The Company reserves the right to substitute equipment with similar alternatives where necessary.
All sizes and specifications are approximate.
Equipment will be set up in one agreed location and will not be moved once installed.
- SITE ACCESS, VEHICLE LIABILITY & ACCESS REQUIREMENTS
The Client is responsible for ensuring that safe, suitable and adequate access is available for delivery, setup and collection of equipment, including sufficient space, ground conditions, and clearance from obstacles.
The Client warrants that they have full authority from the landowner for vehicle access and accept full responsibility for any damage, reinstatement, or permissions required.
Once the Company’s vehicle leaves the public highway, all access is undertaken entirely at the Client’s risk.
The Client acknowledges that adverse weather, including wet ground conditions, may significantly affect vehicle access. The Company shall not be responsible for vehicles becoming stuck, delayed, or unable to access or exit the site due to soft ground, mud, waterlogged surfaces or similar conditions.
The Client shall be liable for any loss, damage or expense arising from unsafe or unsuitable access conditions, including but not limited to:
- Damage to Company vehicles caused by poor access, inadequate surfaces, overhanging trees, restricted access routes or obstacles
- Damage to driveways, lawns, underground services, or other surfaces
- Vehicle recovery costs where a vehicle becomes stuck or immobilised
- Additional labour, time delays, or aborted deliveries
The Client agrees to indemnify and hold harmless the Company against all claims, losses, damages, costs and expenses arising from or in connection with access to the site, except where caused by the Company’s negligence.
Where recovery, delay or disruption results in loss of scheduled work or additional operational costs, the Company reserves the right to recover such reasonable costs from the Client.
The Company reserves the right to refuse access or abort delivery if, in its reasonable opinion, the site is unsafe or unsuitable, including due to weather or ground conditions. In such cases, full charges shall remain payable.
ACCESS REQUIREMENTS (INCLUDING RESIDENTIAL PROPERTIES)
The Client must ensure that there is safe, suitable and unobstructed access to the setup location at all times.
For private residential addresses, the Client is responsible for ensuring that adequate access is available, including but not limited to:
- Sufficient width for equipment to pass through gates, pathways or side access
- Clear routes free from obstacles such as steps, tight turns, low ceilings, or narrow passages
- Adequate space for safe delivery, setup and collection
The Client must inform the Company in advance of any access restrictions, including restricted width access, stairs, long carrying distances, or any other limitations that may affect delivery.
The Client must ensure that the setup area is clean, clear and suitable for installation prior to the Company’s arrival. This includes the removal of any hazards or obstructions such as animal waste, debris, sharp objects or other unsanitary conditions.
Failure to provide suitable access, a clean and safe setup area, or notify the Company of restrictions may result in the Company being unable to complete the setup. In such cases, full charges will remain payable.
- WEATHER, WIND SPEED & SAFE USE
The Company will attend the event at the agreed location, including private residential addresses, and proceed with delivery and setup as agreed, regardless of weather conditions, unless it is unsafe to do so.
All inflatable and outdoor equipment is weather dependent and must only be used in safe conditions at all times.
Inflatables must NOT be used in wind speeds exceeding 24mph (Force 6 on the Beaufort Scale) or in adverse weather conditions including heavy rain or gusting winds.
Where it is safe to install equipment, this does not guarantee that it will be safe to operate at all times during the hire period. Use of equipment remains subject to prevailing weather conditions, including but not limited to wind, rain, and ground conditions.
Where equipment is hired on a dry hire basis (unmanned), the Client is fully responsible for monitoring weather conditions and taking appropriate action to prevent injury or damage. This includes immediately ceasing use and switching off and deflating or powering down equipment where conditions become unsafe, including when wind speeds approach or exceed safe operating limits.
Equipment must not be re-used or re-inflated until conditions have returned to safe operating levels.
The Client must use a suitable wind measuring device (anemometer) to monitor wind speeds throughout the hire period. The Beaufort Scale is provided as a guide only and must not be solely relied upon without accurate measurement.
If the Client does not have an anemometer, the Company can provide one upon request. It remains the Client’s responsibility to ensure it is used correctly and that wind speeds are checked regularly throughout the event.
Where equipment is provided with Company staff (wet hire), the Company will monitor weather conditions and make all decisions regarding safe operation. The Company reserves the right to restrict, suspend, or stop use of equipment at any time if conditions are deemed unsafe.
Safety is paramount at all times. The Company reserves the absolute right to restrict, suspend, or cease operation of any equipment where, in its reasonable opinion, conditions pose a risk to safety.
Such decisions may be made at any time before or during the event and shall be final.
No refunds, reductions, or compensation shall be payable in the event that equipment use is restricted, suspended, or cancelled due to weather conditions or safety concerns.
- SUPERVISION & USE
The Client must ensure adequate, competent, and responsible supervision by persons aged 18 years or over at all times unless wet hire has been agreed. Supervisors must be capable of understanding and enforcing all safety instructions provided by the Company.
The Client is responsible for:
- Safe use of equipment
- Crowd control
- Ensuring all users follow safety instructions
- Ensuring that the maximum number of users permitted on any equipment is not exceeded at any time, as specified on the equipment and/or manufacturer’s safety labels
Unless otherwise agreed in writing, the Client must provide a minimum of one (1) responsible supervisor per item of equipment at all times during use.
For larger events or high footfall, the Client must ensure additional supervisors are provided as necessary to maintain safe operation and control of participants.
The Client is responsible for ensuring that suitable security and effective crowd control measures are in place at all times during the hire period.
The Client shall ensure that sufficient personnel are present to manage participants and spectators, maintain safe distances from equipment, and prevent overcrowding or misuse. This includes the provision (by the Client) and correct use of any barriers, fencing or demarcation required to safely manage queues and separate spectators from operational areas, unless otherwise agreed in writing.
The Company shall not be liable for any loss, damage or injury arising from inadequate crowd control or security arrangements, except where directly caused by the Company’s negligence.
The Company reserves the right to stop use or remove equipment if, in its reasonable opinion, supervision or crowd control is inadequate or safety is compromised. No refunds will be given in such cases.
- DAMAGE & LOSS
The Client is responsible for any damage, loss or theft of equipment during the hire period.
- LIABILITY
Nothing in these Terms shall exclude or limit the Company’s liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded by law.
Subject to the above:
- The Company shall only be liable for loss or damage directly caused by its negligence.
- For Dry Hire, the Client is fully responsible for supervision and use.
- The Company is not liable for misuse, poor supervision, or failure to follow instructions.
For Wet Hire, the Company shall be responsible for the operation of equipment by its staff and for exercising reasonable care in accordance with industry standards.
The Company shall not be liable for any loss, damage or injury arising from the actions, behaviour or misuse of equipment by participants or third parties where such actions are outside the reasonable control of the Company’s staff.
The Company’s total liability shall be limited to £5,000,000 or the level of its public liability insurance, whichever is higher.
The Company shall not be liable for any indirect or consequential loss including loss of profit, revenue, or business.
- PERSONAL PROPERTY
The Company accepts no responsibility for loss or damage to personal belongings.
- ANCHORING & DRILLING OUTSIDE ON HARD SURFACES (IF REQUIRED)
Where required, inflatables may be secured into hard surfaces such as tarmac, concrete or similar using a drill and Rawbolt anchoring system. This process requires the Company to drill into the surface and install temporary anchor bolts.
This WILL leave permanent small holes in the surface following removal. The Company accepts no liability for any damage caused as a result of drilling, and by booking, the Client agrees to this condition.
Bolt holes WILL NOT be filled after removal. If the Client provides suitable materials (e.g. mastic), the Company’s staff may assist with filling the holes at their discretion.
Our anchorage methods include:
- 200mm raw bolts for hard standing surfaces (outside)
- 380mm anchor stakes for grassed areas
- Sandbags for indoor use on hard surfaces
A minimum underground clearance of 500mm is required at all times. The Client is responsible for ensuring there are no underground services, pipes, cables or obstructions within this depth.
PLEASE NOTE:
Drilling and bolting cannot be carried out on surfaces such as flags, flagstones, block paving or similar, as these do not provide sufficient structural integrity for safe anchorage. Each anchor point must be capable of withstanding a minimum of 167kg in accordance with safety regulations.
Drilling will only be carried out on private property owned by, or with the express permission of, the Client. The Company will NOT drill into any third-party property, including council or public land.
The Client warrants that full permission has been obtained from the landowner for any drilling. The Company has no means of verifying this and accepts no liability for unauthorised works. All responsibility in such cases rests solely with the Client.
Hard surface anchoring will only be carried out where:
- The surface is deemed suitable by the Company
- Prior agreement has been made in writing at the time of booking
This must be agreed in writing at the time of booking, as the Company does not carry the necessary drill and bolt equipment unless pre-arranged in advance.
The Company reserves the right to refuse installation if the surface is unsuitable or unsafe.
An additional charge may apply for drill and bolt anchoring due to the additional labour, equipment and time required. This service is typically only available for larger events.
- SPECIALIST EQUIPMENT (RODEO BULLS, BUCKING BRONCOS, RODEO REINDEER & SURF SIMULATORS)
These conditions must be printed by the Client and clearly displayed at the venue for all participants and riders to read.
The use of rodeo bulls, simulators and similar multi-ride equipment involves inherent risk. All participants acknowledge and accept that they may be thrown or fall from the equipment during normal operation.
The Company will provide a trained operator for all rodeo and simulator equipment at all times. The operator will control the equipment and enforce all safety rules. The operator’s decision is final.
Only one participant is permitted on the equipment at any one time.
Participants must:
- Be physically capable of safely mounting and dismounting unaided
- Follow all instructions given by the operator at all times
- Use the equipment in a safe and controlled manner
- Hold on to the equipment using the rope provided at all times while riding
The following persons must NOT use the equipment:
- Anyone under the influence of alcohol or drugs
- Anyone who is pregnant
- Anyone with pre-existing medical conditions that may be aggravated, including but not limited to back, neck, heart conditions, epilepsy or recent surgery
The Client is responsible for ensuring that:
- Adequate space and a safe operating area is maintained at all times
- Spectators are kept at a safe distance from the equipment
- Any barriers or safety zones required are in place where necessary
The Company reserves the right to refuse or stop any participant from using the equipment where, in its reasonable opinion, it is unsafe to do so.
The Company shall not be liable for any injury arising from failure to follow instructions, misuse of equipment, or participant behaviour outside the reasonable control of the Company.
